Terms of use.

1. Who we are

Nebula Controller Mapper ("Nebula", "we", "us") is made and supplied by Francisco Alessandro Sá de Abreu Júnior, Rua Damão 1, 2730-066 Tercena, Lisboa, Portugal (NIF 301054207). Contact: support@nebulamapper.com.

2. What these terms cover

These terms govern your use of the Nebula app — free and Pro — and this website. When you buy Nebula Pro, the payment itself is a separate transaction with our reseller (see section 5); these terms are the software license that comes with it.

3. Your license

• We give you a personal, non-exclusive, non-transferable license to install and use Nebula on computers you own or control, for as long as you follow these terms.
• The free version may be used on any number of your computers. Nebula Pro may be active on up to 2 computers at the same time per subscription.
• You may not sell, rent, sublicense or redistribute Nebula; share, publish or resell license keys; remove its notices; or modify, circumvent or disable its license checks.
• You may not reverse engineer or decompile Nebula, except to the extent the law expressly allows it despite this restriction.
• Nebula remains ours. You get the right to use it; nothing in these terms transfers ownership.

4. Nebula Pro

• Subscription. Pro is a subscription billed in advance, monthly ($7.99) or yearly ($59.99), plus tax where it applies. The price and tax are shown at checkout before you pay.
• Free trial. New subscriptions start with a 7-day free trial. A payment method is needed to start it; you are charged when the trial ends unless you cancel before.
• Renewal and cancellation. The subscription renews automatically at the end of each period until you cancel. You can cancel at any time in your billing portal; Pro stays active until the end of the period you've paid for, then Nebula continues as the free version.
• License checks. Pro is activated with a license key and checked with our reseller's license service when Nebula starts and about once a day. Without a connection, Pro keeps working for 7 days after the last successful check. "Deactivate this PC" in Nebula frees a computer's slot.
• Price changes. We may change Pro's price. We'll tell subscribers by email at least 30 days before it applies to them; the new price applies from your first renewal after that notice, and you can cancel before then.
• Features. Pro includes the Pro features we add in future at no extra cost. We may change or retire features; if we remove a major Pro feature, you may cancel and ask for a pro-rated refund of the current period.

5. Payments through Lemon Squeezy

Nebula Pro is sold through Lemon Squeezy (Link, LLC, formerly Lemon Squeezy LLC), our reseller and merchant of record. Lemon Squeezy takes your payment, charges and files sales tax or VAT, and sends your receipts and invoices; its Buyer Terms apply to the purchase. If they and these terms differ about refunds, our refund policy applies in your favour — we issue refunds through Lemon Squeezy.

6. Refunds and your right of withdrawal

You can get a refund within 14 days of any payment, for any reason — see the refund policy. If you are a consumer in the EU or UK, you normally have a 14-day right to withdraw from an online purchase; because Pro is unlocked immediately, you agree at checkout that it starts straight away, which can end that right early — our 14-day guarantee gives you the same protection anyway.

7. Using Nebula responsibly

Nebula sends ordinary keyboard, mouse and controller input and can create a virtual controller. Some games and services forbid remapping, macros, rapid-fire, virtual controllers or simulated input, and some anti-cheat systems act against them. You are responsible for following the rules of the games and services you use Nebula with, and you must not use Nebula to cheat, to harass others or to break the law. We are not responsible for bans, suspensions or other action a game or service takes against your account. See Is it safe?

8. Third-party components

Nebula includes the SDL library (zlib license). The optional ViGEmBus and HidHide drivers are separate products by Nefarius, installed by you under their own licenses. Nebula's third-party notices ship with the app.

9. Updates and availability

We improve Nebula over time and may release updates that change how it works. We can't promise that Nebula will work with every controller, game, driver or version of Windows, or that the license service will always be available, but we'll act reasonably to fix problems we're told about.

10. Your legal guarantees

Apart from the promises in these terms, Nebula is provided "as is", to the extent the law allows. If you are a consumer, nothing in these terms takes away your statutory rights — including, in the EU and Portugal, the legal guarantee that digital content and services conform to the contract.

11. Limitation of liability

To the extent the law allows, our total liability to you for anything relating to Nebula is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss, such as lost data, profits or game progress. We do not limit or exclude liability for death or personal injury caused by negligence, for fraud, wilful misconduct or gross negligence, or for anything else the law doesn't allow us to limit.

12. Suspension and ending

You can stop using Nebula at any time. We may suspend or end a Pro license that is shared publicly, resold, used to get around the license checks, or bought fraudulently. If we end a license for any other reason, we'll refund the unused part of the period you've paid for.

13. Privacy

How we handle your data is described in our privacy policy.

14. Changes to these terms

We may update these terms; the date at the top shows the current version. We'll email Pro subscribers about significant changes before they take effect, and you can cancel if you don't agree.

15. Law and disputes

These terms are governed by the laws of Portugal. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there. If something goes wrong, please contact us first at support@nebulamapper.com — we'll try to fix it. Consumers can also use an out-of-court consumer dispute resolution entity, such as the Portuguese CNIACC (cniacc.pt).
